Terms of Service

These terms are a binding agreement between you and Meduard Krasniqi, the individual operating uptodate (“uptodate”, “the service”, “I”, or “me”). By creating an account or using the service you agree to them. If you do not agree, do not use uptodate.

1. What uptodate does

uptodate connects to a GitHub repository you authorize, reads the code changes you merge, uses artificial intelligence to identify documentation that a change may have made inaccurate, drafts edits to that documentation, and opens a pull request with the proposed changes. Nothing is published or merged on your behalf. Every change reaches your repository as a pull request that you review and merge yourself.

2. The service

uptodate is currently provided free of charge. It may change or be discontinued at any time, and may contain errors or produce incorrect output. Features, limits, and pricing may change over time. I will give you reasonable notice before introducing fees for continued use.

3. Your account

You must be at least 18 years old and able to enter into a contract to use uptodate. You are responsible for the activity under your account and for keeping your login credentials secure. You must provide accurate information when you sign up. You may sign in with Google, in which case Google’s terms also apply to that sign-in.

4. GitHub authorization and your repositories

To use uptodate you install a GitHub App and grant it access to one or more repositories. You represent that you have the right to grant that access and to have documentation in those repositories analyzed and edited by an automated service. You are responsible for the permissions you grant and can revoke them at any time from your GitHub settings.

5. AI-generated content and your responsibility

The documentation edits uptodate produces are generated by an automated model. They may be incomplete, inaccurate, or unsuitable, and they are proposals only. You are solely responsible for reviewing every pull request before you merge it. uptodate does not merge changes for you and is not responsible for content you choose to merge into your repository or publish from it.

6. Acceptable use

You agree not to:

• use uptodate on repositories or content you do not have the right to access or modify;
• use the service to build a competing product, or to reverse engineer, scrape, or overload it;
• interfere with the service, attempt to gain unauthorized access to it, or use it in a way that breaks the law or infringes anyone’s rights;
• submit content that is unlawful or that you are not permitted to process.

7. Intellectual property

You keep all rights to your code, your documentation, and the pull requests uptodate opens in your repositories. I keep all rights to the uptodate software and service itself. Nothing here transfers ownership of your content to me, or of the service to you. You grant me the limited permission to access and process your content as needed to provide the service, as described in the Privacy Policy.

8. Third-party services

uptodate relies on third parties to function, including GitHub, hosting and database providers, and the AI provider that generates edits. Your use of uptodate is also subject to their terms, and I am not responsible for their acts or omissions. The current list is in the Privacy Policy.

9. Disclaimer

To the extent permitted by law, uptodate is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. I do not warrant that the service will be uninterrupted, error free, or that its output will be accurate or complete.

10. Liability

I am liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body, or health, and where mandatory law (such as the German Product Liability Act) provides for liability. For slight negligence, I am liable only for breach of an essential contractual obligation whose fulfilment makes proper performance of the contract possible and on which you may reasonably rely, and in that case liability is limited to the foreseeable damage typical for this kind of contract. Any further liability is excluded. Because the service is currently provided free of charge, this limitation reflects that.

11. Termination

You may stop using uptodate and delete your account at any time. Uninstalling the GitHub App revokes its access immediately. I may suspend or end your access if you breach these terms or if I discontinue the service. On termination, the permissions you granted end and I will delete or anonymize your data as described in the Privacy Policy.

12. Changes to these terms

I may update these terms as the service develops. If a change is material, I will give you reasonable notice, for example by email or in the app. Continuing to use uptodate after a change takes effect means you accept the updated terms.

13. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country where you live remain unaffected. Where permitted, the place of jurisdiction is Berlin, Germany.
